Privacy Policies

ASEN's Privacy Policy provides its users with a secure web environment. ASEN conducts its activities in accordance with the Act respecting the protection of personal information in the private sector (CQLR, c. P-39.1), hereinafter the "Act." Within this framework, ASEN is committed to maintaining high standards of confidentiality with respect to the personal information provided by its clients, suppliers, partners, and other individuals in the course of its activities, including through its website, social media, advertising, customer relationship management systems, and electronic document management systems, in accordance with the obligations set out in the Act.
What is meant by "personal information"?
"Personal information" means any information concerning a natural person that allows them to be identified, directly or indirectly. Such information may take written, visual, video, or audio form. In the course of its activities, ASEN may collect personal information such as name, address, contact details, identification information, financial information, and any other information necessary for the provision of its services. The following protection principles apply to the collection, use, disclosure, retention, and destruction of personal information provided by users when using ASEN's website or services.

1. Accountability

ASEN is responsible for the protection of the personal information it holds in the course of its activities. To this end, ASEN has adopted privacy practices and internal procedures governing the management of personal information. These measures are intended to govern the collection, use, disclosure, retention, and destruction of such information.

2. Collection of Personal Information

ASEN collects only the personal information necessary for the purposes determined at the time of collection. This information may be collected in order to provide services, respond to requests, manage client relationships, process inquiries, maintain records, improve the user experience, comply with legal obligations, or for any other specific purpose communicated to the individual concerned. ASEN's personnel are encouraged to explain clearly and simply the reasons for collecting personal information to the individuals concerned. Personal information may be collected through online forms, correspondence, verbal communications, documents transmitted to ASEN, or any other interaction with its services.
3. Use and Disclosure of Personal Information

Personal information is used and disclosed only for the purposes for which it was collected, with the consent of the individual concerned, except where the law permits or requires use or disclosure without consent. In certain cases, ASEN may use personal information for other purposes permitted by law, including to prevent fraud, ensure the security of its services, comply with its legal obligations, or provide a service requested by the individual concerned. ASEN may be required to disclose personal information to third parties, including service providers, subcontractors, technology partners, professionals, financial institutions, electronic document management system providers, hosting services, payment services, or other organizations, where such disclosure is necessary for the provision of its services or to meet its obligations. Where a third party processes personal information on ASEN's behalf, ASEN takes reasonable measures to ensure that the third party protects the personal information entrusted to it, uses it only for the intended purposes, and retains it only for the necessary period. Before disclosing personal information outside Quebec, ASEN assesses, among other things, the sensitivity of the information, the purposes of its use, and the protection measures applicable in the place where it would be disclosed. Such disclosure takes place only where the information benefits from adequate protection.
4. Retention and Destruction of Personal Information

ASEN retains personal information only for the period necessary to fulfill the purposes for which it was collected, subject to the retention periods required by law or applicable to its activities. When personal information is no longer necessary, ASEN destroys it securely or anonymizes it, where permitted and appropriate.

5. Data Security

ASEN implements reasonable security measures to protect personal information against unauthorized access, use, disclosure, loss, or destruction. The personal information collected may be stored on servers or in electronic systems using recognized protection mechanisms. These measures are intended to ensure the confidentiality, integrity, and security of the personal information provided to ASEN. A confidentiality incident means, in particular, any unauthorized access to, use, or disclosure of personal information, the loss of personal information, or any other breach of its protection. ASEN has implemented practices to prevent, detect, and manage confidentiality incidents in accordance with applicable requirements.

6. Roles and Responsibilities

A. ASEN, its personnel, collaborators, and representatives, as applicable:
Ensure the confidentiality of personal information;
Adopt good data protection practices; Implement the necessary security measures;
Comply with applicable policies and procedures.

B. Person in charge of the protection of personal information:

Ensures compliance with practices and obligations regarding the protection of personal information; Responds to requests for access, rectification, or withdrawal; Manages confidentiality incidents; Follows up on complaints relating to the processing of personal information.

7. Rights of Access, Withdrawal, and Rectification Any individual, or their authorized representative, has the right to request access to the personal information concerning them held by ASEN. They may also request the rectification of personal information that is inaccurate, incomplete, or equivocal, or withdraw their consent to certain uses or disclosures of their personal information, subject to the limits provided by law.

8. Complaints Any individual who believes they have suffered harm related to the processing of their personal information by ASEN may file a complaint with the person in charge of the protection of personal information. The complaint will be handled diligently, and a written response will be provided within a reasonable time, generally within a maximum of 30 days.
